There are already plenty of lawsuits pending, but MediaBay just added another one to Shawn Fannings pile.
Well, Shawn Fanning just got kicked in his fanny again. Shawn and the illegal service he created just got hit with another...well you know...yet another copyright infringement complaint Thursday, this time by old-time radio show and nostalgia product seller MediaBay.
In its complaint filed in the U.S. District Court for the Northern District of California in San Francisco, MediaBay charged that Shawn Fanning and his service contributed to "vicarious copyright infringement and unfair competition" by trading MediaBay radio programs without its permission, the company said in a statement. The company is asking for an undisclosed amount in damages, and is requesting that Shawn filter out their programs and block them from being traded.
Representatives for Shawn said Thursday that they had no comment on MediaBay's charges. What they really meant to say is they are dealing with so many other lawsuits and pile after pile of court ordered instructions TO comment on another new lawsuit.
Shawn and his illegal service have been busy fighting a copyright infringement lawsuit that was filed by the Recording Industry Association of America in December 1999.
Hit with a court injunction (his first BIG black eye), Shawn Fanning has been implementing a series of filters recently to weed out his service's copyright material, but some are still claiming that the rogue site has not gone far enough in protecting their copyrighted works.
In a statement, MediaBay said that it believes that the court's injunction against Shawn Fannings illegal Service "is a key step toward leveling the playing field for legitimate downloadable audio companies."
